This Privacy Policy sets forth the rules for processing personal data collected through the website <strong>intelisky.pl<\/strong>, hereinafter referred to as \u201ethe Website.\u201d.<\/p><p>2. The owner of the website and the data controller is <strong>InteliSky Micha\u0142 Lukoszek, 41-808 Zabrze, 55\/5 Ireny Kosmowskiej St., Tax ID (NIP): 6482713321<\/strong>, hereinafter referred to as the Administrator.<\/p><p>3. Personal data collected by the Administrator through the Website is processed in accordance with <strong>Regulation (EU) 2016\/679 of the European Parliament and of the Council<\/strong> of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95\/46\/EC (<strong>General Data Protection Regulation<\/strong>), also known as <strong>GDPR<\/strong>.<\/p><p>4. The Administrator takes special care to respect the privacy of Customers visiting the Website.<\/p><\/section><section><h2>\u00a7 1 Type of Data Processed, Purposes, and Legal Basis<\/h2><p><strong>1.<\/strong> The controller collects information regarding natural persons who perform legal acts not directly related to their business activities, natural persons conducting business or professional activities in their own name, and natural persons representing legal entities or organizational units that are not legal entities but are granted legal capacity by law and that conduct business or professional activities in their own name, hereinafter collectively referred to as <strong>Clients<\/strong>.<\/p><p><strong>2.<\/strong> The Administrator processes Customers\u2019 personal data in connection with their use of the contact form on the Website to the extent necessary to perform the contract or to take steps prior to entering into a contract\u2014the legal basis for processing is Article 6(1)(b) of the GDPR<\/p><p><strong>3.<\/strong> When using the contact form, the Customer provides the following information:<\/p><ul><li><strong>email address<\/strong><\/li><li><strong>first name<\/strong><\/li><li><strong>phone number<\/strong><\/li><\/ul><p><strong>4.<\/strong> While using the Website, additional information may be collected, including, in particular: the IP address assigned to the Customer\u2019s computer or the external IP address of the Internet service provider, the domain name, the browser type, the time of access, and the operating system type. Navigation data may also be collected from Customers, including information about links and hyperlinks they choose to click on or other actions taken on the Website for purposes related to the provision of services, as well as for technical, administrative, analytical, and statistical purposes\u2014in this regard, the legal basis for processing is also Article 6(1)(f) of the GDPR, i.e., necessity for purposes arising from the Controller\u2019s legitimate interest, which is to ensure IT security and manage the Website, as well as to improve the functionality of the Website and the services provided.<\/p><\/section><section><h2>\u00a7 2 Recipients of the data<\/h2><p><strong>1.<\/strong> The Customer\u2019s personal data is disclosed to service providers used by the Controller in operating the Website. The service providers to whom personal data is transferred, depending on contractual arrangements and circumstances, are either subject to the Controller\u2019s instructions regarding the purposes and methods of processing such data (<strong>data processors<\/strong>) or determine the purposes and means of processing on their own (<strong>administrators<\/strong>).<\/p><ul><li><p><strong>1.1. Data Processors.<\/strong> The Administrator uses service providers who process personal data solely at the Administrator\u2019s instruction. These include, among others, providers of hosting services, accounting services, marketing systems, website traffic analysis systems, and systems for analyzing the effectiveness of marketing campaigns.<\/p><\/li><li><p><strong>1.2. Administrators.<\/strong> The Administrator uses service providers that do not act solely on its instructions and determine their own purposes and methods for using Customers\u2019 personal data. These providers offer electronic payment and banking services.<\/p><\/li><\/ul><p><strong>2. Location.<\/strong> Service providers are based primarily in Poland and in other countries of the European Economic Area (EEA).<\/p><p>3. Upon receiving a request, the Controller shall disclose personal data to authorized state authorities, in particular to organizational units of the Public Prosecutor\u2019s Office, the Police, the President of the Personal Data Protection Office, the President of the Office of Competition and Consumer Protection, or the President of the Office of Electronic Communications.<\/p><\/section><section><h2>\u00a7 3 Data Retention Period<\/h2><p><strong>1.<\/strong> Customers' personal data is stored:<\/p><ul><li><p>1.1. If the basis for processing personal data is consent, the Customer\u2019s personal data is processed by the Controller until such consent is revoked, and after consent is revoked, for a period corresponding to the statute of limitations for claims that the Controller may assert and that may be asserted against the Controller. Unless otherwise provided by a specific provision, the statute of limitations is six years, and for claims regarding periodic payments and claims related to the conduct of business activities\u2014three years.<\/p><\/li><li><p>1.2. If the basis for data processing is the performance of a contract, the Customer\u2019s personal data is processed by the Controller for as long as necessary to perform the contract, and thereafter for a period corresponding to the statute of limitations for claims. Unless otherwise provided by a specific provision, the statute of limitations is six years; for claims regarding periodic payments and claims related to the conduct of business activities, it is three years.<\/p><\/li><\/ul><\/section><section><h2>\u00a7 4 Cookies and IP Addresses<\/h2><p>1. This website uses small files called cookies. They are stored by the Administrator on the visitor\u2019s device, provided the web browser allows it. A cookie typically contains the name of the domain from which it originates, its \u201eexpiration time,\u201d and a unique, randomly generated number that identifies the cookie. The information collected through these files helps tailor the products offered by the Administrator to the individual preferences and actual needs of visitors to the website.<\/p><p>2. The administrator uses two types of cookies:<\/p><ul><li><strong>2.1. Session cookies:<\/strong> Once the browser session ends or the computer is turned off, the stored information is deleted from the device\u2019s memory. The mechanism of session cookies does not allow for the collection of any personal data or confidential information from customers\u2019 computers.<\/li><li><strong>2.2. Persistent cookies:<\/strong> They are stored in the memory of the Customer\u2019s device and remain there until they are deleted or expire. The mechanism of persistent cookies does not allow for the collection of any personal data or confidential information from the Customer\u2019s computer.<\/li><\/ul><p>3. The administrator uses first-party cookies for the following purposes:<\/p><ul><li>3.1. analyses, research, and audience audits, and in particular to generate anonymous statistics that help us understand how Customers use the Website, thereby enabling us to improve its structure and content.<\/li><\/ul><p>4. The administrator uses third-party cookies to:<\/p><ul><li>4.1. displaying, on the Website\u2019s information pages, a map showing the location of the Administrator\u2019s office, using the maps.google.com website (third-party cookie administrator: Google Inc., based in the U.S.)<\/li><\/ul><p>5. The use of cookies is safe for the computers of Customers visiting the Website. In particular, it is not possible for viruses, other unwanted software, or malware to enter Customers\u2019 computers through this method. However, customers can restrict or disable cookies in their browsers. If they choose to do so, they will still be able to use the Website, with the exception of features that, by their nature, require cookies.<\/p><p>6. The Administrator may collect Customers\u2019 IP addresses. An IP address is a number assigned to a visitor\u2019s computer by an Internet service provider when they visit the Website. An IP address enables access to the Internet. In most cases, it is assigned to a computer dynamically, meaning it changes with each Internet connection and is therefore generally considered non-personally identifiable information. The Administrator uses IP addresses to diagnose technical problems with the server, to generate statistical analyses (e.g., to determine which regions account for the most visits), as information useful for administering and improving the Website, as well as for security purposes and the potential identification of unwanted automated programs that overload the server while browsing the Website\u2019s content.<\/p><\/section><section><h2>\u00a7 5 Rights of Data Subjects<\/h2><p>Data subjects whose data is being processed have the following rights:<\/p><p><strong>1. The right to withdraw consent to data processing at any time:<\/strong><\/p><ul><li>1.1. The customer has the right to revoke any consent they have given<\/li><li>1.2. The withdrawal of consent takes effect as of the time the consent is withdrawn<\/li><li>1.3. Withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent prior to its withdrawal<\/li><li>1.4. Withdrawal of consent does not entail any negative consequences for the Customer; however, it may prevent the Customer from continuing to use services or features that, by law, the Administrator may provide only with the Customer\u2019s consent<\/li><\/ul><p><strong>2. Right to object to data processing:<\/strong><\/p><ul><li>2.1. The customer has the right at any time to object\u2014for reasons related to his or her particular situation\u2014to the processing of his or her personal data based on Article 6(1)(e) or (f) of the GDPR, including profiling based on those provisions. The controller may no longer process such personal data unless it demonstrates compelling legitimate grounds for the processing that override the interests, rights, and freedoms of the data subject, or grounds related to the establishment, exercise, or defense of legal claims.<\/li><li>2.2. Opting out via email of marketing communications regarding products or services shall constitute the Customer\u2019s objection to the processing of their personal data, including profiling, for these purposes<\/li><\/ul><p><strong>3. The right to have data erased (\u201ethe right to be forgotten\u201d):<\/strong><\/p><ul><li>3.1. The customer has the right to request the deletion of all or some of their personal data<\/li><li>3.2. The customer has the right to request the deletion of personal data if:<ul><li>3.2.1. The personal data is no longer necessary for the purposes for which it was collected or processed<\/li><li>3.2.2. has withdrawn a specific consent, to the extent that the personal data was processed based on that consent<\/li><li>3.2.3. has objected to the processing pursuant to Article 21(1) of the GDPR and there are no overriding legitimate grounds for the processing, or has objected to the processing pursuant to Article 21(2) of the GDPR<\/li><li>3.2.4. Personal data is processed unlawfully<\/li><li>3.2.5. Personal data must be erased to comply with a legal obligation under Union law or the law of a Member State to which the Controller is subject<\/li><li>3.2.6. The personal data was collected in connection with the provision of information society services<\/li><\/ul><\/li><li>3.3. Notwithstanding a request to erase personal data, in connection with the filing of an objection or the withdrawal of consent, the Controller may retain certain personal data to the extent that processing is necessary to establish, assert or defend legal claims, as well as to comply with a legal obligation requiring processing under Union law or the law of a Member State to which the Controller is subject. This applies in particular to personal data including: first name, last name, and email address\u2014which are retained for the purpose of handling complaints and claims related to the use of the Controller\u2019s services\u2014as well as, additionally, the residential address\/mailing address and and order number, which are retained for the purpose of handling complaints and claims related to concluded sales contracts or the provision of services<\/li><\/ul><p><strong>4. Right to restrict data processing:<\/strong><\/p><ul><li>4.1. The customer has the right to request that the processing of their personal data be restricted. Until the request is processed, submitting it will prevent the customer from using certain features or services whose use would involve the processing of the data covered by the request. The controller will also not send any communications, including marketing communications.<\/li><li>4.2. The customer has the right to request that the use of personal data be restricted in the following cases:<ul><li>4.2.1. if the data subject disputes the accuracy of their personal data\u2014in such cases, the Controller shall restrict the use of such data for the time necessary to verify its accuracy, but for no longer than 7 days<\/li><li>4.2.2. when the processing of data is unlawful, and the Customer requests that the use of the data be restricted rather than having it deleted<\/li><li>4.2.3. when personal data is no longer necessary for the purposes for which it was collected or used, but is needed by the Customer to establish, pursue, or defend claims<\/li><li>4.2.4. if the data subject has objected to the processing of his or her data\u2014until it is determined whether the controller\u2019s legitimate grounds override the data subject\u2019s grounds for objection<\/li><\/ul><\/li><\/ul><p><strong>5. The right to request access to your personal data from the Data Controller and to receive a copy of it:<\/strong><\/p><ul><li>5.1. The Customer has the right to obtain confirmation from the Controller as to whether personal data is being processed, and if so, the Customer has the right to:<ul><li>5.1.1. access your personal data<\/li><li>5.1.2. obtain information about the purposes of processing, the categories of personal data being processed, the recipients or categories of recipients of such data, the planned retention period for the Customer\u2019s data, or the criteria for determining that period (when it is not possible to specify the planned data processing period), about the rights to which the Customer is entitled under the GDPR and the right to lodge a complaint with a supervisory authority if the personal data was not collected from the data subject \u2013 all available information regarding the source of the data, automated decision-making, including profiling as referred to in Article 22(1) and (4) of the GDPR, and\u2014at least in such cases\u2014relevant information regarding the rules governing such processing, as well as the significance and anticipated consequences of such processing for the data subject, and the safeguards applied in connection with the transfer of personal data outside the European Union<\/li><li>5.1.3. obtain a copy of your personal data. The right to obtain a copy must not adversely affect the rights and freedoms of others<\/li><\/ul><\/li><\/ul><p><strong>6. Right to rectify (correct) data:<\/strong><\/p><ul><li>6.1. The Customer has the right to request that the Controller immediately correct any inaccurate personal data concerning him or her. Taking into account the purposes of processing, the Customer, as the data subject, has the right to request that incomplete personal data be completed, including by submitting an additional statement, by sending a request to the email address specified in \u00a76 of the Privacy Policy.<\/li><\/ul><p><strong>7. Right to data portability:<\/strong><\/p><ul><li>7.1. The Customer has the right to receive the personal data they have provided to the Controller and then transfer it to another data controller of their choice. The Customer also has the right to request that the Controller transfer the personal data directly to such a controller, provided that this is technically feasible. In such a case, the Controller will send the Customer\u2019s personal data in the form of a CSV file, which is a commonly used, machine-readable format that allows the received data to be transferred to another personal data controller.<\/li><\/ul><p><strong>8. The right to file a complaint with a supervisory authority:<\/strong><\/p><ul><li>8.1. The customer has the right to file a complaint with the President of the Personal Data Protection Office regarding any violation of their rights to the protection of personal data or other rights granted under the GDPR<\/li><\/ul><p>9. If a Customer exercises a right under the provisions above, the Controller shall comply with or refuse the request without delay, but no later than one month after receiving it. However, if\u2014due to the complex nature of the request or the number of requests \u2014 the Controller is unable to comply with the request within one month, it shall comply within the following two months, having first notified the Customer\u2014within one month of receiving the request\u2014of the intended extension of the deadline and the reasons for it<\/p><p>10.
